How it works

  • Answer a few questions about your bond claim: cleaning, damage, or general wear and tear, and what your condition report says.
  • Your report explains the law that applies, in plain English, and what it means for your situation.
  • If your landlord has claimed the bond without your agreement, your report explains the 14-day time limit, applying to NCAT, and what that step involves.
  • A suggested email to your landlord or agent is included, written around your own answers, for you to finish and send yourself.

Common questions

What counts as fair wear and tear in NSW?

Ordinary deterioration from normal use and everyday conditions, not damage. Your report sets out where that line sits in the law and applies it to the answers you give: it cannot decide whether a specific mark or item is fair wear and tear on your property, since that is a question of fact, not law.

What if my landlord already lodged a bond claim I disagree with?

Act quickly. NSW Fair Trading will pay the landlord's claim unless, within 14 days of its notice, you apply to NCAT and tell Fair Trading in writing that you have applied. Telling Fair Trading you dispute the claim is not enough on its own. Your report explains that step for your situation and includes a suggested email to your landlord or agent setting out your position, for you to finish and send.

Do I need to go to NCAT myself?

Not always. Before your landlord lodges a claim, many bond disagreements are resolved directly between tenant and landlord once the position is set out clearly in writing. Once a claim has been lodged, the 14-day NCAT step above applies. Your report explains when NCAT becomes the next step and what that involves, but we do not represent you there.
